13.9.4.4 A written agreement is reached between the employer and the worker, indicating the conditions for granting these courses. Mr. Sectoral agreements refer to an agreement between the employer and the Union/s of a given class on the conditions, including the requirements for professional promotion and entry into the professional career and other specific conditions, in a given class. iv. These appointments are made within one (1) month after the signing of this agreement. 5.1.1 The Government ensures that there is no discrimination or intimidation in favour or against workers on the basis of membership or non-membership of the Union and undertakes to provide UNION officials with appropriate assistance in carrying out their legitimate duties under this agreement, unless the government`s activities are impeded. The « Identity of Malta » agency and the General Workers` Union (GWU) have signed a new collective agreement for the next five years. The new agreement builds on the previous agreement and covers the period from January 1, 2019 to December 31, 2023. Wage flexibility is governed by uniform collective agreements in both the manufacturing and retail banking sectors, as collective bargaining in Malta takes place at the enterprise level. It should be noted, however, that in their respective sectors, collective agreements implemented in some organizations influence other sectors.

Indeed, many producing companies have been pushed to improve wage conditions and offer VPS to attract and retain the best performing employees. This social process has also affected banks operating in Malta. Recently, there have been no below-inflation wage stoppages or wage increases under collective agreements with unions and/or works councils. The absence of such cases is due to the legal wage increases associated with the annual cost of living index. However, in cases where organizations are going through difficult times, a special request for a waiver may be made to the Ministry of Labour and Employment Relations (DIER) under the responsibility of each case. It is then up to the director of DIER, the employer and the union to agree on the adoption of such mechanisms. 6.2 Without prejudice to clause 7.3 in cases where a group of workers is already governed by a sectoral agreement, their original signatories are respected in all the intentions and purposes of the same inter-professional agreement. iii. This board of directors is composed of one president and two members, all three appointed by the government in agreement with the unions. The House should be convened within 15 days and arbitration should not take more than two (2) months to present the report. Traditionally, Maltese unions have tended to prefer SVPPs, which result in wage increases for as many workers as possible, such as for-profit schemes, over individual systems such as those based on individual performance evaluations. The latter have often been the subject of disputes between unions and employers on the basis of an alleged injustice.
