During a transitional period, the authorities assess each other`s pharmaceutical legislation, guidelines and regulatory systems under the agreement. There are other examples of mutual recognition of the rules, including the EU-US marine equipment regulation in 2004, the Trans-Tasman Mutual Recognition Arrangement between Australia and New Zealand (TTMRA) in 1998 and the EU-Swiss MRA in 2002. The UK document reaffirms the importance of regulatory autonomy – « respect for the regulatory law of each party » – but also follows earlier considerations by proposing that the agreement « creates a framework for both parties to require the other to consider its technical regulation as equivalent to its own regulation. » For example, the European Commission`s recent free trade agreements with Canada and Korea provide for the conclusion of a compliance assessment MMA, without asking their partners to adapt their regulatory requirements to those of the EU. The AGREEMENT between the EU and Australia covers the following areas in which the contracting parties to the MRA ACCORD are not required to change their technical rules and that is why the UK government is now proposing MMAs for compliance assessment as part of their new trade agreements. The EU internal market is the most comprehensive version of mutual recognition between trading partners. According to the Dijon Cassis principle, a product that can be legally sold in one Member State can be legally sold in any other Member State, even if the rules are not harmonised. MRAs will provide licensed engineers in these entities with an equivalent level of licence in Canada and vice versa. Engineers Canada is not a licensing body – our task is to do our best to encourage ratification of the agreement by the 12 Canadian regulators, in accordance with the ratification/implementation clauses. In the Brexit negotiations, the UK government called for mutual recognition of the rules, including in Theresa May`s florence speech and as an option for future regulation of financial services, but refused by the EU. In all cases, enhanced MRA will be concluded either on the basis of broad and deep regulatory alignment, resulting from a unique and close relationship between the two partners (for example. B.dem internal market of the European Union or TTMRA) or international standards (for example. B EU-US MRA for marine equipment based on international maritime rules).

By granting mutual recognition of products covered by free trade agreements with Canada and Korea, but which refuse to give the same treatment to products originating in the United Kingdom, the EU could violate WTO legislation. Engineers Canada is a signatory to two multinational agreements: in 2017, the MRA has been suspended and incorporated into the EU-Canada Comprehensive Economic and Trade Agreement (CETA), which will come into force from September 2017. The suspended MRI will end with CETA coming into force until it is ratified by EU member states. These agreements benefit regulators by reducing dual controls in any other area, allowing for a greater focus on sites likely to be at higher risk and increased coverage of global supply chain inspections. CEPs are usually concluded with candidate countries with which the EU has association agreements (see our presentation on association agreements) and are a step in the accession process. The aim of the EPCA is to bring the technical rules of a candidate country in line with those of the EU in terms of preparation for EU membership. This type of MRA is by nature temporary, as it disappears when the country joins the EU internal market.
