If a list contract ends and the seller enters into a new list agreement with another agent, it is important that the new agent informs the new agent of an extended clause still valid for the previous agent. A common argument can be avoided when renewing the contract using the entire rate, so there is no argument as to whether the extension is correct or not. A due clause protects the listing agent from losing a commission he has earned, even if the contract has expired. For example, a seller may hope to reduce closing costs if they sell their home. To do this, they might try to avoid paying the brokerage commission. If the seller goes behind the agent`s back and makes a deal to sell the house to a buyer after the expiry of the listing contract, the seller could save money by not paying the agent`s commission. Listing contracts may also have a broker safeguard clause that entitles the broker to a commission if the property is sold to a buyer introduced by the broker within a specified period after the expiry of the listing agreement. The period of implementation of broker protection clauses is often the same period as the listing agreement. The listing agreement may have a multiple listing clause that allows the broker to list the property on the Multiple Listing Service (MLS), which is both an association of brokers and a real estate database provided by brokers participating in the Multiple Listing Service. Only real estate that a broker is allowed to sell exclusively or who is the exclusive agent can be listed in the MLS. All brokers have the right to sell any property on MLS, regardless of the agent who listed it. The broker is the broker who has signed an exclusive right to sell or an exclusive agency list, while the selling broker is the broker who finds a buyer for the property.

Brokers who are part of the Multiple Listing Service agree to divide the commission between the listing broker and the sales broker. An owner can enter into an exclusive listing agreement with a real estate agent. The duration of these agreements varies, but three months are common. During these three months, the realtor usually works hard to get potential buyers to see the home. Real estate agents work on commission, which means they are paid on the basis of the sale and price of the real estate. This motivates them to attract as many potential buyers as possible. A buyer`s agency agreement, such as a listing agreement, is an employment contract, but the broker represents the buyer – the client – as his representative and his agent.
